Rights and obligations of the seller

Price of goods and procedure for their payment

- The delivery fee is not included in the price of the product, unless explicitly stated otherwise.
- The Buyer can pay for the goods in one of the following ways: The Buyer can pay using the Paysera (mokėjimai.lt) payment system, with the help of which the Buyer will be directed to his e-mail. banking.
- By bank transfer to the account: after choosing the payment methods 6.5.1 and 6.5.2, and not paying for the goods within 2 (two) working days, KOMFORTAS.EU has the right to cancel the order without prior notice.

Delivery of goods
- The Seller delivers the goods in Lithuania
- The buyer, having chosen the delivery service during the order, undertakes to indicate the exact delivery address, postal code, exact contact telephone number and other additional information (staircase code, etc.).
- The buyer undertakes to accept the goods himself. In the event that the Buyer is unable to accept the goods himself and delivers the goods to the specified address, the Buyer shall not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
- The buyer undertakes to accept the goods the day after receipt of the notice that the consignment will be delivered to him. If the buyer does not accept and / or collect the shipment, it will be transported repeatedly. For repeated deliveries, the Seller has the right to charge the Buyer if these deliveries will incur additional costs.
- The goods are delivered by the Seller, the Seller’s authorized representative (courier).
- The Seller delivers the goods to the Buyer in accordance with the terms specified in the Product Descriptions. In exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the control of the Seller.
- The delivery price is fixed and does not change when purchasing more than one item.
- If the buyer notices any violations of the packaging during delivery, he must indicate the comments in the delivery document provided by the courier or draw up a separate report regarding these violations. The Buyer must do this in the presence of a courier. Failure to do so shall release the Seller from liability to the Buyer for any damage to the goods related to packaging damage that the Buyer has not identified in the courier’s delivery document.
- The buyer has no discretion to change the delivery address of the goods once the shipment has left. If the place of delivery is changed in person in consultation with a courier or other service providing delivery, the Seller is not responsible for meeting the delivery deadline and has the right to charge the Buyer for additional costs incurred due to arbitrary change of the customer’s delivery address. (Costs incurred may be covered by an additional invoice to the Buyer or deducted from the amount of returned goods.
Warranty
- The goods sold in the e-shop are guaranteed by the manufacturer.
- In the event that the Seller does not provide a guarantee for certain types of goods, the guarantee provided in accordance with Lithuanian legislation shall apply.
- The validity period of the goods sold in the store is unlimited, unless otherwise stated next to the goods.
Return and exchange of goods
- The return of goods takes place in accordance with the retail trade rules approved by the Government of the Republic of Lithuania.
- In order to return the goods, the Buyer may do so within 14 (fourteen) days from the delivery of the goods to the buyer. The Buyer must inform the Seller by e-mail. by mail and by filling in a special return form, indicating the name of the returned goods, the order number and the reasons for the return.
- The money will be transferred to the bank account specified by the Buyer no later than 14 days after the return of the goods and purchase documents (ie the invoice).
- The Buyer is not reimbursed for the delivery costs of the Goods.
- The cost of returning the products (without defects) is borne by the Buyer.
- The returned product must be in the original neat packaging, undamaged, unused, without the same equipment as the Buyer received, without losing the appearance of the product (undamaged labels, etc.) (this item does not apply in case of return of defective product). When returning the product, it is necessary to present the document of its purchase.
- The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with 2., 3. and 5. the terms and conditions for the return of the goods set out in The goods returned by the buyer will be assessed whether the products have been returned in accordance with the above conditions. If the conditions have not been met, the money will not be refunded. Delivery or pick-up in such cases will be negotiated individually.
- When returning the received wrong product and / or defective product, the Seller undertakes to accept such goods and replace them with similar suitable goods within a reasonable time.
- In the event that the Seller does not have goods suitable for replacement, the amount paid for the goods shall be refunded to the Buyer.
Exchange of information
- The Seller shall send all notices to the e-mail address provided in the Buyer’s registration form.
- The Buyer shall send all notices and questions to the address specified in the “Contacts” section of the Seller’s e-shop.
Final Provisions
- Electronic stores KOMFORTAS.EU.lt The rules have been drawn up in accordance with the legal acts of the Republic of Lithuania, therefore the law of the Republic of Lithuania applies to the relations arising on their basis.
- All disputes arising out of or in connection with the contract of sale between the Buyer and the Seller shall be settled by negotiation. In case of failure to reach an agreement, disagreements shall be resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
